Terms of Service

1. Acceptance of Terms
By engaging EraBright's services, accessing our website, or signing a service agreement, you agree to be bound by these Terms of Service.
2. Services Description
EraBright provides marketing services for local service businesses through tiered plans (Foundation, Growth, Full Demand Gen), which may include website development, search engine optimization, paid advertising management, social media management, and related automation services, as detailed in your service agreement.
3. Payment Terms
Services are billed monthly in advance. Full Demand Gen clients' advertising spend is billed separately, at cost, with no markup, and is passed through directly to the advertising platform. Late payment may result in suspension of services until the account is brought current.
4. Contract Term & Cancellation
Standard service plans require a minimum 6-month commitment, which includes a bundled website build. Clients may cancel with 30 days' written notice after the minimum term is completed. Month-to-month service is available; clients selecting this option pay a separate, standalone website build fee not eligible for the bundled-term discount. If Client cancels prior to completing the 6-month minimum term, the remaining balance for the full term becomes immediately due.
5. Client Responsibilities
Client agrees to provide accurate business information, timely approval of content and creative assets, and access to necessary accounts (e.g. Google Business Profile, ad accounts) required for EraBright to perform services.
6. Intellectual Property & Site Ownership
Websites and creative assets built by EraBright remain the property of EraBright during the service term. Upon completion of the required minimum term (or full payment of the standalone website fee for month-to-month clients), ownership of the website transfers to the Client. If the Client cancels prior to completing the minimum term, EraBright retains ownership of the website and associated assets.
7. Service Guarantees & Disclaimers
EraBright does not guarantee specific search rankings, lead volume, or revenue outcomes. Marketing results depend on numerous factors outside EraBright's control, including market conditions, competition, and platform algorithm changes.
8. Limitation of Liability
EraBright's liability under this agreement is limited to the amount paid by Client in the preceding 3 months. EraBright is not liable for indirect, incidental, or consequential damages.
9. Termination
EraBright reserves the right to terminate services for non-payment, misuse of services, or breach of these Terms, with written notice.
10. Governing Law
These Terms are governed by the laws of the State of Georgia.
11. Changes to Terms
EraBright may update these Terms from time to time. Continued use of services after changes constitutes acceptance of the updated Terms.
